Feedback on Issues Raised by FMM at the Royal Malaysian Customs Department-Private Sector Consultative Panel Meeting 1/2011 (CD/3/2011)

The first Customs-Private Sector Consultative Panel meeting for 2011 was held on April 28, 2011. The Customs Department provided the following responses to the issues raised by FMM at the Consultative Panel:

  1. Online Application and Renewal of Licensed Manufacturing Warehouse (LMW) License
    The Customs Department and XYBASE Sdn Bhd are presently developing the Customs Portal that has 12 sub-modules under the ‘eLesen’ application. The Customs Portal, once developed, will facilitate online applications and renewals of LMW licenses.

  2. Imposition of Stricter Penalties against Fraudulent Declarations
    As penalties stipulated under Section 133(1)(g) of the Customs Act 1967 on falsification of documents and incorrect declaration are not stringent, FMM is concerned that the proposed self-certification of preferential Certificate of Origin (CO) currently being pursued under the ASEAN Trade in Goods Agreement (ATIGA) would lead to greater falsification and forgery of documentation. Customs has agreed to convene a discussion with FMM to address these concerns.

  3. Replacement of the Old Scanning Machine at North Butterworth Container Terminal
    The Customs Department has submitted a proposal to the Government requesting funds to purchase a new scanning machine for the North Butterworth Container Terminal (NBCT).

  4. Validity Period of Form CJ5
    The Customs Department will retain the option of six (6) months or twelve (12) months validity period for sales tax exemption under the Sales Tax-5 (CJ5) facility until the Goods and Service Tax (GST) is implemented and enforced nationwide.
